DISTANCE SALES AGREEMENT
ARTICLE 1 – PARTIES
This Agreement has been executed between the following parties under the terms and conditions set forth below.

1.2 BUYER
(The individual or legal entity placing the order)
ARTICLE 2 – DEFINITIONS
For the purposes of the implementation and interpretation of this Agreement, the terms below shall have the meanings set forth opposite them:
MINISTER: Ministry of Customs and Trade
MINISTRY: Ministry of Customs and Trade
LAW: Law No. 6502 on the Protection of Consumers
REGULATION: Regulation on Distance Contracts (Official Gazette: 27.11.2014 / 29188)
SERVICE: Any consumer transaction other than the supply of goods, performed or promised in return for a fee or benefit
SELLER: The company that offers goods to consumers within the scope of its commercial or professional activities
BUYER: The real or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes
SITE: The website owned by the SELLER
ORDERING PARTY: The real or legal person requesting goods or services through the SELLER’s website
PARTIES: The SELLER and the BUYER
AGREEMENT: This agreement concluded between the SELLER and the BUYER
GOODS: Movable property subject to shopping and intangible goods such as software, audio, and visual content prepared for use in electronic media
ARTICLE 3 – SUBJECT
This Agreement regulates the rights and obligations of the Parties regarding the sale and delivery of the product ordered electronically by the BUYER through the SELLER’s website, in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
The Parties declare that they are aware of and understand their obligations and responsibilities arising from the relevant legislation.
ARTICLE 4 – GENERAL PROVISIONS
4.1 The basic characteristics of the goods/products (type, quantity, brand/model, color, unit count) are published on the SELLER’s website. If a campaign is organized, the relevant product features can be reviewed during the campaign period.
4.2 Listed prices on the website are sales prices. Prices remain valid until updated or changed.
INVOICE INFORMATION
ARTICLE 5 – DELIVERY
5.1 This Agreement enters into force upon electronic approval by the BUYER and is fulfilled when the goods are delivered to the BUYER. Delivery shall be made to the address specified by the BUYER.
5.2 If the BUYER is not present at the delivery address, delivery may be made to authorized persons at the address against signature. Delivery information will be communicated to the BUYER via SMS and/or email.
ARTICLE 6 – BUYER’S DECLARATIONS AND UNDERTAKINGS
The BUYER declares and undertakes that:
They have received, read, and approved preliminary information regarding the product, price, payment, delivery, and right of withdrawal.
Failure to complete payment or cancellation in bank records terminates the SELLER’s delivery obligation.
Goods must be inspected before delivery; damaged goods must not be accepted.
In case of suspected fraud, the SELLER may request identity and card ownership verification.
Provided personal information is accurate and lawful.
The website will not be used unlawfully or abusively.
The SELLER is not responsible if delivery is refused by a third party designated by the BUYER.
ARTICLE 7 – SELLER’S DECLARATIONS AND UNDERTAKINGS
7.1 Products shall be delivered within the legal maximum of 30 days.
7.2 If fulfillment becomes impossible, the SELLER shall notify the BUYER and refund payments within 14 days.
7.3 The SELLER is responsible for loss or damage until delivery.
7.4 Products shall be delivered complete, defect-free, and compliant with legal standards.
7.5 Equivalent products may be supplied with BUYER’s consent.
7.6 Force majeure events may extend delivery time or result in cancellation.
7.7 The SELLER may contact the BUYER for communication, marketing, and notification purposes.
7.8 External links do not constitute endorsement.
7.9 Violations may result in legal liability.
ARTICLE 8 – RIGHT OF WITHDRAWAL
The BUYER may withdraw from the contract within 14 days of delivery without justification or penalty.
Exceptions to the right of withdrawal include:
Customized or personalized goods
Perishable goods
Hygiene-sensitive products once opened
Digital content delivered instantly
Services started with consumer approval
Refunds will be processed within 14 days of notification.
ARTICLE 9 – DEFAULT AND LEGAL CONSEQUENCES
In case of default due to credit card payment, the BUYER accepts responsibility under the agreement with the issuing bank and agrees to compensate any damages incurred by the SELLER.
ARTICLE 10 – DISPUTE RESOLUTION
Consumer Arbitration Committees or Consumer Courts at the BUYER’s residence or transaction location shall have jurisdiction within statutory limits.
ARTICLE 11 – EFFECTIVENESS
This Agreement enters into force upon electronic approval by the BUYER and remains valid upon delivery of the goods.
PERSONAL DATA PROTECTION
Buluş Organic attaches great importance to the protection of personal data in accordance with Law No. 6698 on the Protection of Personal Data (KVKK).
Collection & Processing
Personal data may be collected verbally, in writing, or electronically via website, social media, and communication channels for service provision, campaigns, complaints, and business operations.
Data Transfer
Personal data may be shared with business partners, suppliers, public authorities, and third parties domestically or abroad in compliance with legal requirements.
Data Subject Rights
Individuals have the right to:
